Like a wife's neighbour , she mortgaged her land to bank to loan $$$ to her. Once u repaid, you can do it again to loan $$$.
So I guessed the case u mentioned, the owner should be able to do that, but then if he is unable to settle the loaned $$$, subsequently you will have problem no matter what type of agreement you may have with the owner.

how come the rental examples you cited are so cheap? are they the run down local type of accommodation? the rental i know of in hcmc are many many times more expensive
