That is not a loophole my dear "Dirty Boy" You may be surprised to know that we are actually allowed to backdate as the Court have no way of determining when the "unreaonsble behaviour" of your spouse starts, moreover we are basing on past events to argue for the divorce

What you have stated is the same as KT, that is provided it is totally uncontested by both parties, but you also forgot about the pre-trial conferences (behind chambers) before the actual open court session (open chambers)

Your friend should have engaged a competent lawyer to fight his case instead of waiting 7 years, in my humble knowledge there should be no stated statutes of limitation for such issues so the 7 years wait is actually puzzling to me. An experienced lawyer would have advised your friend to do the following,

01) Serve the notice on her last known address and the NOK's at Sabah.

02) Put out advertisements on all major newspapers in Malaysia.

03) Engage a PI to track her down.

Once you have proven to the court that you have already tried and exhausted all avenues to reach her, the Court may then decide the divorce case in her absence.
